Right now, I'm involved in a situation with a new neighbor that is planning to take out our old line fence (that I paid for) and put a new fence in of his own. The only problem is that state law here mandates that I pay for half of the new fence, or a judgment can be placed against the land. I know that this doesn't answer your question, but just points out that laws can vary from area to area.
