I'm not sure I've seen a factory rops that I'd completely trust. Not enough gusseting and cross/X bracing to keep it from collapsing like scissors. Not heavy enough metal for the rollover force(weight times speed of rollover, etc.) Then the weak points are the attachment points. Anything under 1" bolts for the axle attachments are suspect. The front attachments may just be welded onto plate held by a few little bolts and not necessarily the frame.
Finally, just like cars, a seat belt is a must or you end up getting thrown and then rolled over on.
That lawsuit could come from a member of your own family as well. Just like in a car accident where the driver is at fault(negligent) and the passenger(s) who are probably family member(s) such as a wife or kids get hurt. They end up having to sue their own Husband/dad/driver to collect under their own car insurance. Happens all the time.
