The brakes are most likely rusty as you thought.
Just keep running it but make sure the little weep hole in the bottom of the brake housing stays open. That little weep hole is there to let out brake dust and rust.You can clean it with a little screw driver.
If dust and rust build up inside the drum it will tear up the brake discs and the brakes will lock up.
The hole is a little slot right where the drum meets the rear end housing.
