OT what would you do in this situation

i had made plans last nite at 9:00, to go and look at a sawmill today the guy said he would be home from work at 5:00 , i said great i will be there between 5:00 and 5:30 he said that would be fine. So i quit working early today drove 90 miles, got there at 5:25. i said hi, is this the place with the sawmill? he said its been sold, my wife sold it this afternoon. I said &^$%*&*^^***^. ok then and left. How does everybody else handle these situation. I always say someone else is looking at it tonite, i will take your name and number and call you if they are not interested.
anyway anybody know where there is a sawmill for sale near dubuque iowa. I am lookking to add one to our show this year. needless to say i am a bit frustrated

I think This is rather odd. I called a guy on one of these saw mills and he said are you the guy that is comming Sat morning? I said no, but it is raining so I just called. He said I best come because another guy was coming Sat. This was Friday morn and I went to check it out.

I purchased it with a friend in mind who always wanted one. I called him Friday eve and he gave me the location of another one in the same town he was going to look at Sat morning. Well he got off work Friday noon and went to look at the saw mill but a guy had came Friday morning and bought it. Yea you all guessed correct. I told him he could use it till the day he died as my sons did not want anything to do with it.

We had a game plan for sure in our small world. Only problem was he was married to a lovley wife that said no way. Now I have a saw mill for sale. Hummmmm

I have bought and sold lots of things. If I want something, I go as fast as I can get there(with the money) . If someone beats me to it, I loose. That is the way it is. There will be another (maybe even better!) deal down the road. I have gotten to places way early and you would be surprised to see things as they really are ( IE: starts great and see them with the either cans etc.) If I sell something, the first person with the money gets it. I am still waiting for people to show up. Also, be on time! If I have to be someplace and the person is late, I leave. The late person can come another time. I get phone numbers and will call when I am on my way to look at something or will call to tell an item is sold if I have an appoitment with a person comming down. I know nothing is pefect but when people start to find falt with everything and even make up stuff to cut you down ,I just tell them I guess this item is not what they are looking for and it was nice meeting them but I have to go. You would be surprised how fast they are ready to then buy.

I had the same thing happen on a john boat drove 2 hours to see it and was sure to buy it if it was as described when I called I told him I was on the way and was from about 2 hours away. When I told him that he said he would wait for me, I showed up in time and boat was gone. Told him that was not the gentlemanly thing as he didn't even give me time to get there and I was paying asking price

Ain"t it funny, I have bought alot of stuff off the side of the road or out of the paper and never delt with the wife. Every one always says the wife sold it. Who is buy"n all this stuff from people"s wives?

the guy did know where i was coming from, hasd my phone number, and told me he would not behome from work until 5:00. i would have went that night or in the morning had i known that was a option. so life goes.

I think a few are overlooking what was in the post. He was called at bedtime, was good time. He went to work, did not get home till 15 minuts before customer was to arive. He was at work, could not be called and at work did not know what wife was doing, customer was already on way 3/4 of way there when seller found out what wife had done, how does seller get a hold of customer, customer may not have a cell phone. Seller should have told wife if anybody calls tell them a customer is to be here 15 minuts after I get home, if no show or does not take you have chance, will call you at 6:00 and let you know if it is still avaible.

Hard to win in these cases...from a sellers stand point I've had "I'm coming to look at it on Saturday" "I'll buy it, hold on to it" (no show) "I'll call later today" (never do)

If I do have someone coming, I ask that they call before the leave to make sure I'm around. Had "I'll be there at 2:00" or whatever turn into 2 hours late, to no show/no call.

I ALWAYS call ahead if it's a decent drive away...

I am thinking the OP did not have a cell phone?

So the guy sold it.
Someone came and offered him the asking price maybe. What should he say, "Oh sorry I cannot take your money as someone else is coming to look at it" ????? That would be more rude then what happened.
So trust someone with cash in his hand or some stranger that you have no idea if he will show or not?

i worked for a machinery dealer we had cleaned up and worked on a nice ihc disc. man came in wanting to buy a disc but he wanted to try it to learn if it would do a good job of discing corn stalks. i took disc out and some time later farmer called and said i don't like your disc come and get it back. i went to get it sitting next to it was a new disc
i think he wanted ours until his new one was ready. salesman told me yes i know he got a new somewhere else.

I had the very same deal pulled on me with a tractor.He promised me first chance on it if I got there within 24 hours..At least I called just before I left for the 300 mile drive to go look at it.Thats when he told me that the wife sold it while he was in town.

I bought a tractor over the phone from a JVS school in paris ky.I got up at 4am to get there at 9am to meet the JVS teacher at his house.When i arrived his wife said he had to substitute that morning and would not be home for 3 hours.I waited in a walmart parking lot for 3 hours,he shows up and says he decided not to sell it.I told him i wanted a 100 bucks for my trouble,but he didn't care at all what i went through.I just told him if a mans word isn't any good he doesn't have much,and i left.

Well its 'one of those situations'.I have lost count of the number of times someone has said they'd come for some reason and never show up.If I had been you before I would have driven 90 miles I would have told the guy I'll call before I head your way and ask hime to hold the item for the time it it took me to drive there.Dealing with total strangers I'd figure its for sale until some $$$ changes hands.

Well he took the money when he could. You might not have bought it right? But he shouldve had the courtesy to contact you and let you know either someone was looking that night or if he had your cell phone - tell you that he sold it. Next time better call the seller when you get in the truck to go and confirm.

Its just an unfortunate lack of communication.At least you can keep this in mind for next time.I would just drive back home to cry about my gas wasted but not say anything much to the guy.I always say Ill call you when Im leaving in these deals.

I have been on both sides of this problem. Not too often when I sell that I have that many interested people though. If I know someone is on their way I will hold it for them until they can get here. Just did this the other day on a JD 318. I can also tell you I have had more than my share of no shows and maybe want to come looksies.

That's a fact of life in sales. Whoever put the money on the table first, gets the product.

I'm cynical from being on the other side of the desk. People basically have no consious when dealing with salesmen. One example is, one morning when I was selling cars for GM, a local lady I knew came in and wanted to demo drive a particular car. She was gone for a couple of hours, came back, and said she'd decided against it. That afternoon I saw her driving another car with In Transits on it.

All she'd done was use our car and burn our gas to have wheels to go to another town 20 miles away to buy a car.

Like someone else said, get used to it.

Been there done that. Last summer saw a ad for NH68 baler. Just so happens I need another for parts. Price was right so I was not even concerned if it worked. I called and said I would take it. I told him I needed to run to Mora and drop off some stuff but would pick it up on the way back.
He said ok.
Of course it was gone when I got there.

He said the WIFE sold it.
Now I dont know about you. My wife is not selling any thing with out talking to me 1st.

I was not mad though. Disapointed yes.
I should have went there 1st and gave him the money. Then went to Mora.

Now if I was going to drive 90 miles to look at it. Maybe I would be Poed if he didnt call me.

I might have made the comment.
At least you could have bought me a drink 1st before you let me have it.( using different words ofcourse)

Common courtesy is painless. Personally, if I knew there was someone else interested, I would say so. I don"t know if the seller had your phone #, but if it was me and I had your number, I would have called to let you know it had sold. If it was first one with the money gets it, I would tell you that, too. The seller was not obligated to tell you the mill had sold, but again, it would have been common courtesy to call and let you know.

I had a similar situation with a set of tractor tire chains recently. I got ahold of the guy, he said there was someone else interested, but they had until sunday to come get them. I told him to call me sunday, said he would call either way to let me know. He never called, so I called him monday, said he had another guy interested (he skipped my place in line) and that this guy had until sunday. This went on for three weeks until he finally sold them.

Cuss and walk away - No way of handling inconsiderate people.

Wife and friend had similar happen to them this weekend. Lady called and asked about purchase of several bunnies. Was very specific about what she wanted. We raise a special breed, and have done very well on showing them, same with friend. Top quality bunnies. So wife and friend package up several bunnies - friend agrees to drive halfway across state to meet this gal at a rabbit show in Lapeer. Gets there, and can't find the buyer. Finally finds a cell number and calls this person. Seems she found another breeder at the show, bought from her, and left. Friend then had to go to the Detroit area to be with her aging father. So these poor bunnies spent the whole weekend cooped up in these tiny cages, riding around in the back of a pickup. Not a pleasant situation. What you going to do?

You are your own best advocate when it comes to managing your money, your time, your health, your safety and your family. Knowbody has any interest in doing it better than you. If you allow somebody else to take control then you can't complain.

In this day and age of cellphones you should have called before leaving work early. You should have called again before driving the 90 miles to see the item. You cannot and should not leave it up to the other party to protect your best interests.

I agree that the guy could have had some courtesy and told you he sold it before you went to all the trouble to go there, but maybe he didn't know how far you had to go. If you were just coming over from the next town or he had no reason to believe you weren't from close by, then tough bananas, but if he knew you had a long drive to get there, he should have told you or at least tried. At least I would have.

That's one where you just have to write it off as "that's life". Did you tell him on the phone that you were definately buying it? If not, it's his sawmill and his right to sell it whenever and to whomever he has the opportunity. I hate to sound like a hardazz about it, but if you've ever sold ANYYTHING, be it over the internet, through a newspaper classified add, even with a simple FOR SALE sign in your front yard, you'll understand how many "I want it"'s and how many "I'm on the way"'s you get, vs how many actually show up, money in hand and ready to buy.

In the event I have to drive more than a few minutes to see something listed for sale, I always leave my phone # and ask to be called if it sells before I get there.

You can't haul someone into court because they sold something that is theirs to sell. It's unfortunate what happened, but it's sure not criminal.

He should have had the courtesy to call you when it was sold to save you the drive. But unless he said he would hold it for you, I think think he was in the right. Whoever shows up first with cash in hand gets it. And if you want someone to hold something for you, you should give them a deposit up front. (Of course, that wasn't possible in your case.)

sympathize w/ your situation, has happened to me. Lately I've been catching the other end of it, folks promising to show up and never making it. Or coming and offering 1/2 the price I was asking.My new rule is whoever shows me the cash is the new owner. I would show the courtesy of a call immediately upon sale to other interested parties

If the price was better than what you can get it elsewhere for then you can take him to small claims court for the difference. Sometime it just makes one feel better to let them know it will cost them for being stupid.

The guy said he was going to look at the sawmill- unless he made a firm offer to buy over the phone, and the offer was accepted by the seller, "looker" has no legal rights or remedies if its sold out from under him. Even then, an oral contract is not a contract unless both parties agree that it was- and defaulting buyer is going to sing a different tune in court.

Now, the bunny deal is another matter- sounds like a deal was definitely made, and I'd be going after the defaulting buyer for expenses.

I've been down both sides of this road- was selling an item that turned out to be more popular than I expected (or maybe, underpriced)- so I tried to schedule the lookers in the order they called. Turned into a real cluster f- some couldn't come "that early"- so what do you do? Have the first one come at 10, then the second can't come til 3, so what about caller #3, that wants to come at 9? Or between #1 and #2? Finally gave up and said, get here as soon as you can, bring money, first cash on the table gets it.

Damn straight!!!! Take him to court for feeding his family... That'll teach him a thing or two.

If someone wants to come see a puppy, kitten, horse, or anything we have for sale, they are told that whatever it is is for sale until it is bought or a deposit is made to hold it. Depending on the tone after that, we decide to flex or not.
OTH, wives do some crazy things. Mine got rid of a 6 ton dump wagon cause she decided it was in the way when I was gone for a couple of days. Coulda killed her.

i am used to it. and i should have known better. i guess i believe in telling my wife what is going on, and he told his wife to call me but she never did. i guess that i have a little more respect for a persons word than some others. oh well

That's really what it comes down to - respect.

I have found a lot of folks on this board seem to have lost that - respect for others - first one with money wins, don't care nothing about anyone else..... Hard to take their complaints about no-shows seriously (tho I understand that is a pain too), when it's all about screwin' people to make the sale.

Kinda sad.

Money talks! It's a catch 22 for the seller. A lot people that are coming to look at stuff never show up. Next time maybe a phone call before you leave could verify if it is still available for sale. It does kind of suck though. Hope you find another one. Dave

Of course you aint happy. I wouldn't be either. I can't imagine no one would be. I can't think that the guy knew that the wife sold the sawmill before he talked to you, before he got home. I can't think he knew it would be gone and just wanted you to come over and get upset. Know what I mean? Did he have your number to call you back? Chalk it up to sometimes things don't go like we plan. It happens...to me anyways. Sorry about the deal, but there'll be another.
