OT EBAY seller scammed me, advise please

Hey guys, I have a very unusual situation. I won an auction on ebay for a Gehl chopper and chopper wagon back in August, 2006. I was the high bidder on both items and ebay informed me that I was the winner. The seller then informed me that the items had been sold locally. He had not ended the auction, he just added an addition note to the item descriptions saying they had been sold locally. We went thru SquareTrade, as I wanted to figure out how he was going to solve the problem. The seller told us the items were already gone so there was nothing he could do to resolve things Well squaretrade was unable to resolve anything so I walked away with nothing gained. Now 5 months later this dirt ball seller has an item on ebay for sale, and as I am looking at the current item listed, I see the exact chopper, hay head, and chopper wagon that I had won sitting in the back ground. I have seen pictures of these items in his other listings but the previous listings had no snow on the ground, so I could not prove that the pics were current. But the item he has now listed is sitting in a foot of snow, and I happen to know that Michigan has just had snow for less than a month. My question is, I know the seller is lieing thru his teeth, he never sold the items I won, he didn't bother putting a reserve on the auctions, and since he didn't feel that my bid was high enough, he just "sold the items locally". What should I do, how do I approach ebay about this situation. I am thinking I will go to his lot to look at the item he now has for sale, and take pictures of the Gehl equip that should be mine. I just don't know what ebay can do or how I should approach things? Would really appreciate any advice. Brian

you cant go by pictures, at one time i had ten 1066 ih tractors, i had 3 jd 660 hay rakes, with out serial numbers whos to say its not different eq

Hey guys, not to burst any bubbles on here but I have had great experiences using ebay. The items I purchased have been as good or better than what I have expected and the people that I have corresponded with I have bought other items from after ebay as some of them are businesses.

I have bought expensive items such as tractors and small things such as parts.

I have also sold items on there and yes I had trouble with a couple people trying to scam me with money orders and one that fell through after so saying he lost his job and couldnt pay. I figured he told his wife and she freaked out and he was facing her.

Anyway, I have my father in laws 1976 GMC Farm Pickup on there now for sale and so far so good on it.

Like anything else, be careful and be cautious. Be firm yet reasonable.

If someone really wants what you have they will go the extra mile. If you want what someone has you do the same.

I have bought things on here and you all have been great to deal with. You all have given me tons of information, as well as assisted in repairs that you all have given me the courage to tackle.

I know if you all wanted to scam me you could have said put this wire here and that one there and this tube here and that thing there and caused me a lot of trouble. BUT, I trusted you all and you didn't let me down.

Sometimes we win, sometimes we lose!!!

Best I can say is count your blessings and go on. What we dont see taken care of here on earth, someone else will take care of for us later and I sure wouldn't want to be in their shoes!!!

Could be too that the ad photo he posted later, with the items n the back that you thoguht you bought, was taken at an earlier time, or someone paid him for the items and did not pick them up. I used to buy some things off e-bay, but now only sell, there are too many dishonest people out there. Even selling, I've had people run bids up beyond the reserve, just to see what the reserve was, and then never pay.

When selling, you can either put a reserve or a starting bid on an item. Why someone would not do that on a higher priced item is beyond me.

You could sue the seller and ebay, but that is going to cost you. I suspect it will cost you a lot more than the money you would have saved if you had actually got the items bought. So as others have said, get over it. It won`t be the last time that something doesn`t go your way either.

Technically, does ebay even ALLOW an auction to be ended early because of local sale?

I though when an item was listed, ebay rules required the auction to proceed, except for VERY special circumstances, like theft of the item.

I think folks that try that CRAP should be booted off of ebay, for good!

To bad it'a one of the group here, that would pull a stunt like that!

The seller can go in there and just yank the auction at any time.

Not too good for public relations, but better than letting it run it's course and then sell to someone else.

Just bad business practice.

Before you start spreading rumors about other people, maybe you should look at the facts! I but and sell alot of equipment THAT is NOT the items I listed that you thought you won. Do you think That Gehl only made one harvester and it was for you! I think you are a dirt bag for lising this post and furthermore too dumb to read the word SOLD!

The seller is amazing, I never went so far as to mention a name, or even location, just the fact that he lived in Michigan, yet his guitly conscience has tipped his hand. He states that the machinery he has on his lot now is just a coincidence that it is the same model that I won in the auction. What he doesn't realize is that I have had a local farmer go by his place and take pictures of both the chopper and chopper wagon, and upon emailing me the pics, they are the exact same machines that I won in the ebay auctions. I am not able to match serial numbers but by comparing pics it is wierd how the machines are rusted in the same exact spots, as well as the corn head that is on the chopper and the hay head sitting in the yard are the exact same paint as can be seen in original ebay sale pics. In my dealings with Square Trade, the seller told them that the items were already gone so there was nothing he could do to resolve the situation, and as I can now prove with pics, the seller just didn't feel like selling for the auction price. If he was any sort of honorable gentleman, he would have since contacted me and told me that he had "a new set of equipment" on his lot that I might be interested in. But he wouldn't do that because the new set of equip is the exact same pieces I already won by auction. Sorry guys, don't mean to belly ache, kind of glad some guys understand where I am coming from. I realize likely nothing can be done, just in awe that another machinery person could be so crooked. Not trying to be rude but at this point I think it is called for, anyone that uses ebay would be wise to avoid deaking with 'TRACTORBLOOMS'. Brian

So I take it you are the shady character who lied to ebay, this buyer and square trade stating that the chopper and wagon were "sold locally" to avoid having to sell them for less than what you feel is fair value?

Although I agree this is water under the bridge for the prospective buyer, it is not a fair way to do business on ebay...nor elsewhere. Put a reserve on items if you won't take any less than a given figure.
If you don't want to play buy the rules sell elsewhere. It's not worth one's reputation to make a few extra bucks on some machinery.

He didn't scam you, he just refused to sell to you. It may have been sold locally, or not.

You're not out any money, you just didn't get to buy the wagon you wanted.

Brian, you asked for advise - Mine is get over it - find another chopper. If he was a stand up guy, you'd have the equipment, he'd have your money. Obvious though, he isn't. Even if you could force him to sell, do you want to buy from this clown? You'd probably get the machinery with parts missing, loose bolts, etc. If you REALLY want the stuff, drive over there & try to make a deal, or hire a lawyer, 100.00/hr? - Plenty of good dealers out there, this guy isn't one of them.

If he scammed you and you are out money, and you still want to follow up on it, ok go there, do your thing.....
If you lost no money ....get over it, he is a looser and you are better than him, just report it to ebay

You can set up a few bogus accounts, then everytime he posts something to sell, just bid it sky-high so he can't get any legitimate bids. Dirty pool, to be sure, but so is what he's doing.

At least you werent out $5K or something. I would guess that IF the guy is legit he didnt want to sell the items for that price, maybe. Remember that it is buyer beware on Ebay, I had bid on a set of gage blocks last year and after the "bidding" was over I got an email saying, "Oh we still have these and the high bidder didnt buy" maybe its true maybe its not.

GET OVER IT!

You're not out anything but your time, wasted watching and bidding on the ebay item.

If he is that dishonest, BE GLAD he didn't follow through on the sale. Who knows what condition the equipment would have be in, or any other "catches" that might have gone with the deal, had he completed the sale!

I think you got by pretty lucky, compared to SOME guys who actually GET the machinery (junk) they bid on!

I do a fair bit of seling on e-bay.

Guys like this need to be turned in. What evidence do you have? Don't know what is needed but if you had SN#s that would be best. Did you keep the e-mails?

Turn him in. It is the only way to keep things safe for all. May take a handful of situations like yours but I have seen a couple of people removed.

No I do not have any serial numbers, but if I get pictures of the items as they set on his lot, the pics can be compared to the listing of the items I have in MY EBAY section. The chopper and hay head are very obviously the same ones that I won, even setting in the same spot in his lot. I know there is no way to positively ID these like serial numbers but the old rusty machinery in the pics is very obviously the same. How do I approach ebay about getting something done.

Usually on such things you have to dig deeper than you should have to. Start with Dispute and counsel and got from there. Make sure you keep the info you need. If he host's his own pictures he can pull them.

Plead you case with E-bay. It is in their best interest to do something.

Just don't throw out the baby with the bath water. It is a good way to buy and sell. But like all other things the buyer should always beware. Also you aren't out any cash.
