In Dike Ia a very large [80 combines and 30 newertractors on lot at most times]was closed on Tue by a US Marshal. He owed Case IH 22 Million. Mechcanics were allowed one at time in to get their personal tools.

Same thing happened to some JD and other dealers here during droughts. The local dealers stick it to the little guys making them shop someplace else and cater to a few of bigger farmers giving them more discounts and when those guys go under it takes the dealer out. Then no one has service and more mergers and driving farther for parts. Some that have stuff in that dealers shop might not have fun trying to get it back and claimed or it may take a while or could get auctioned like others said.

Some of those dealers get pretty clever at fooling the manufacturer, but Case has been lenient and careless over the years. However, that situation could never get that bad without the manufacturer's reps "looking the other way" on a lot of things. Allis-Chalmers was more thorough on those matters, although the local rep could manipulate a lot of things and hide them from the company for a long time. Personally, I stayed on top of dealer inventory all of the time and tried to keep the dealers out of trouble - 'cause once you lose a dealer, you're out of business in that area.

Sucks when that happens. Hope customers get there stuff back. The one time I had this happen to a dealer (not Ag) I was dealing with, the law allowed them to auction off everything in their posession unless I could prove ownership. Ever try to dig up a recepit for something you have had for 20 years? Otherwise you want it back you go buy it.

On newagtalk they mentioned a couple CNH dealerships that have been closed down. That was one of them mentioned.

If Case-IH really let them get/pushed them into a 22 million $$$ default then I think the company should eat it. I for one hopes no one shows up for the auction!

I don't understand your line of thought.

Here's a guy that was dishonest to Case IH, himself, his employees, and in the end his customers and his community. Just because Case was lax in their oversite you should steal from them. I don't think so.....

Let us hope the dealer had reason(motive) to let it go that far (Financliy).Unknown to me(more stringent bankrupecy Laws just imposed).without knowing whole story-he could have been left out to hang!! and this is avenue to be brought before Fed. Judge to state his case!! Being that big, his internal(bookkeepers-CPA,personal lawyer-are saying make a statement!!!! Wayne

Wayne, the new bankruptcy laws apply to personal bankruptcy and do not apply to businesses or corporations.
The new laws were driven by the credit card industry.
