John Deere 314 sight glass and filter

On a JohnnDeere 314 garden tractor there is a tube that goes off the fill tube on the rear differential to the sight glass to a Filter back into the top of the differential.
The parts drawings that I have seen and the local John Deere dealer all say that there is filter in that line.
However I wonder why they have a filter in this line and not a breather. There does not seem to be a breather for the rear differential.
So is it a filter or a form of a breather.
The reason I ask is that i do not have that filter in there right now and it is difficult to get fluid in the rear differential unless I pull the sight glass tube off the top of the rear differential. If tube is off I can fill with no problem. If tube is in place then oil comes back up the filler tube and spills out.
So is it a filter or breather?
I do have one on order
 
I am thinking the filter is the breather. The filter is open to the air on one end, right? The filter element would just keep dust from contaminating the hydraulic fluid.
 
The original clear plastic in-line filter was was modified in that it had a small hole drilled in it to serve as vent.
 
Like wore out said, the filter has a small hole in it to act as a vent. Needs to have the hole to allow the air to leave the tube and show the correct level of fluid in the transaxle.

First photo is of (likely the original) filter with a vent hole on a tractor in my shop, second is of a new AM36965 filter just out of the bag it came in.

You can see the vent hole in both.
